 RETAIL 

+ Ruby Liu’s bid for Hudson Bay leases declined by judge’s order; landlords are now ‘more free’ to realize on their security and release those spaces. For professionals in our industry, we understand, but readers might be confused if they’ve been following this story. Shopping centre leases for anchor department store retailers vary from location to location, landlord to landlord, but two issues are key to the leases of ‘all leases in the shopping centre’ – ‘what happens when the anchor goes dark, and the rational of mall tenants paying premium rents and CAM costs while anchors pay ‘less than proportionate costs and rates’, because the anchor draws traffic for all tenants; the capability of Ms. Liu to finance and operate stores of typical anchor strength of concept, management and credibility was at the root of the landlords’ opposition to her plans. The potential impact on shopping centre values and enforceability of leases, financing, etc. were a collective ‘too much risk’ from numerous perspectives. This issue might drag on a while longer as the HBC insolvency winds down. Just my view … but Ms. Liu should open a store or two, demonstrate her concept as profitable, demonstrate performance of covenants to landlords, and the attention of landlords will come … or not.
